Los Angeles Federal Credit Union ("Credit Union") maintains this World Wide Web site (the "Site") as a service to our members. PLEASE CAREFULLY READ THESE TERMS OF USE (“TERMS”) BEFORE USING THE SITE. BY USING THE SITE, YOU ARE AGREEING TO COMPLY WITH AND BE BOUND BY THESE TERMS. You may not copy, display, distribute, transfer, link to, reproduce, license, frame, alter, create derivative works of, or republish all or any portion of the Site for any commercial or public purpose without the Credit Union’s prior written consent.
2. Use of Credit Union Information
The Credit Union authorizes you to download or copy Credit Union Information, provided that you retain all copyright and other proprietary notices contained in the original materials on any copies of the materials and that you comply strictly with these Terms. You may not modify, edit, or take out of context Credit Union Information such that its use creates a false or misleading statement or impression as to the positions, statements, or actions of the Credit Union. Except as specifically permitted pursuant to these Terms, the Site is for your personal and non-commercial use. You acknowledge that any Credit Union Information on the Site is only made available or provided to you for informational purposes, and that the Credit Union does not guarantee the Information is comprehensive, accurate, or current. If you breach any of these Terms, your authorization to use Site automatically terminates and you must immediately destroy any downloaded or printed materials. Unauthorized use of the Site may give rise to a claim for damages and/or be a criminal offense.

5. Potential Disruption of Service
Access to the Site may from time to time be unavailable, delayed, limited, or slowed due to, among other things:
• hardware failure, including among other things failures of computers (including your own computer), servers, networks, telecommunication lines and connections, and other electronic and mechanical equipment;
• software failure, including among other things, bugs, errors, viruses, configuration problems, incompatibility of systems, utilities or applications, the operation of firewalls or screening programs, unreadable codes, or irregularities within particular documents or other content;
• overload of system capacities;
• damage caused by severe weather, earthquakes, wars, insurrection, riots, civil commotion, act of God, accident, fire, water damage, explosion, mechanical breakdown, or natural disasters;
• interruption (whether partial or total) of power supplies or other utility of service;
• strike or other stoppage (whether partial or total) of labor;
• governmental or regulatory restrictions, exchange rulings, court or tribunal orders, or other human intervention; or
•any other cause (whether similar or dissimilar to any of the foregoing) whatsoever beyond the control of the Credit Union.
6. Your Activity on the Site
For your protection and the protection of the Credit Union network and Site, all activity on the Site may be monitored and recorded, and you agree that the Credit Union may do so. The Credit Union may monitor your use of the Site for purposes including but not limited to the Site and transaction security and usage tracking without prior notice to you. Further, you acknowledge and agree that the Credit Union is permitted to share or disclose any and all activity, as well as any information derived from your activity, on the Site, with its employees, agents, service providers, licensors, and other persons to the extent permissible under its Privacy Policy and applicable law. You agree that you will protect all information that allows for access to Site, as well as the computer, tablet, mobile phone, or other device used to visit the Site, including but not limited to passwords, or other login information.
7. You warrant and represent that your activities on the Site are not in violation of applicable law, or of the terms and conditions of any other agreements you have with the Credit Union.

YOU ACKNOWLEDGE THAT THE CREDIT UNION AND ITS RESPECTIVE EMPLOYEES, AGENTS, THIRD PARTY SERVICE PROVIDERS, OR LICENSORS DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR FREE; NOR DOES THE CREDIT UNION MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SITE, OR AS TO THE TIMELINESS, SEQUENCE, ACCURACY, RELIABILITY, COMPLETENESS, OR CONTENT OF ANY INFORMATION, SERVICE, OR MERCHANDISE PROVIDED THROUGH THE SITE. THE CREDIT UNION DOES NOT ENDORSE PRODUCTS OR SERVICES APPEARING ON LINKED SITES OR PURCHASED VIA LINKED SITES (THIS DOES NOT AFFECT ANY MANUFACTURER'S WARRANTIES THAT THE PROVIDERS OF THE LINKED SITES OTHERWISE OFFER). 8. Governing Law and Venue
These Terms shall be governed by and construed in accordance with the laws of the State of California, U.S.A., without reference to any conflict of law principles. You hereby consent to venue in and jurisdiction of the state and federal courts sitting in the State of California.
9. Indemnity
You agree to indemnify, defend, and hold harmless the Credit Union and its officers, directors, employees, successors, affiliates, and assigns from and against any and all claims, demands, losses, liabilities, penalties, expenses, and any or other damages (including, without limitation, reasonable attorneys’ fees) directly or indirectly resulting from, relating to, or arising in connection with: (1) your breach or violation of these Terms; (2) your use of the Site; (3) any transactions or other activities you engage in with any third party service providers, third party merchant sites, or other third parties who are part of our affiliate program or who you access by or through the Site; (4) your infringement or violation of the intellectual property or other rights of third parties; and (5) your negligence or willful misconduct.
10. Change in Terms
The Credit Union reserves the right to change these Terms in whole or in part at any time without prior notice except as otherwise required by law or as otherwise agreed in writing. The most current version of the Terms will always be available to you by on the DISCLOSURES page accessible from the bottom of any page on the Site. If you find the Terms unacceptable at any time, you shall discontinue your use of the Site. By continuing to use the Site after the date of ANY CHANGE TO THESE TERMS, INCLUDING ACCESSING THE SITE, YOU AGREE TO BE BOUND BY THE RULES CONTAINED IN THE MOST RECENT VERSION OF THESE TERMS. THE CREDIT UNION MAY DISCONTINUE OR MAKE CHANGES IN THE INFORMATION, PRODUCTS, OR SERVICES DESCRIBED HEREIN OR PROVIDED ON THE SITE AT ANY TIME WITHOUT PRIOR NOTICE TO YOU AND WITHOUT ANY LIABILITY TO YOU. 11. Limitation of Claims
Any action or any claim against the Credit Union must be brought by the user within one (1) year following the date the claim first accrued, or shall be deemed waived.
12. Entire Agreement
These Terms constitute the entire and only agreement between us and you, and supersede all prior or contemporaneous agreements and understandings, express or implied, oral or written, except as herein contained, with respect to the Site, the content, products, or services provided by or through the Site, and the subject matter of these Terms.
13. Privacy Policy
Our PRIVACY POLICY , as amended from time to time, is incorporated herein by reference and shall be deemed a part of these Terms for all intents and purposes.
14. No Waiver
No waiver of any of the foregoing terms and conditions shall be effective unless it is in writing and signed by an authorized officer of the Credit Union, and no waiver shall be deemed to imply or constitute a continuing waiver of any other term or condition.
